This feasibility study report is based in part on information not within the control of Fluor Daniel Pty Ltd and HA Simons Limited ("the Joint Venture"). While it is believed that the estimates and conclusions contained herein will be reliable under the conditions and subject to the qualification set forth, the Joint Venture does not warrant or guarantee their accuracy. Use of the feasibility study report is therefore at the user's sole risk. Such use shall constitute a release and agreement to defend and indemnify the Joint Venture from and against any liability (including but not limited to liability for special, indirect or consequential damages) in connection with such use whether the liability is asserted to arise in contract, tort (including negligence), strict liability or other theory of law.
